Judge Orders Clinic to Stop Performing Abortions

A judge is ordering New Woman, All Women Health Care in Birmingham to stop performing abortions.

A judge has ordered a Birmingham clinic to stop performing abortions because the facility isn't licensed to provide them.

   Jefferson County Circuit Court Judge Joseph Boohaker said Thursday that the clinic - New Woman, All Women Health Care - is considered a hospital under state law but doesn't have a current state health board license.

   Health officials cited the clinic for dozens of violations last year and the operators agreed to close. But a doctor was still performing abortions at the site.

Judge Considers Bid To Close Abortion Operation

A circuit judge says he will rule by Friday on whether to shut down what Ala. health regulators say is an illegal abortion clinic in Birmingham.

Alabama health regulators are telling a judge that a doctor and a building owner are operating an illegal abortion clinic in Birmingham.

Health Department lawyer Brian Hale argued during a hearing Monday that Dr. Bruce Norman and Diane Derzis are wrongly running an abortion clinic, despite Derzis surrendering her abortion clinic license last year over health violations.

Norman testified that he performs abortions at the site regularly. But attorneys for him and Derzis say the facility is a legal doctor's office, not an abortion clinic under state law.

State Of Ala. Trying Again To Shutdown Abortion Clinic

The state is trying again to close a Birmingham abortion clinic that has been cited for rampant health violations.

Alabama health regulators have tried since 2012 to close an abortion clinic that was cited for rampant health violations.

Now, a judge has set a hearing for Monday on whether the facility can remain open.

Officials say a woman with deep ties to abortion clinics, Diane Derzis, is playing a legal shell to keep the center open.

Derzis and an associate own the Birmingham building. They agreed last year to surrender their license after being cited for violations including inadequate patient care.

Alabama health officials say they're again trying to shut down a Birmingham abortion clinic they claim is operating illegally.


The state asked a judge in Birmingham on Tuesday to close New Woman All Women Health Care, calling it an unlicensed abortion provider.


Operators agreed to shut down the clinic last year after a state investigation found irregularities.


But an attorney for the Department of Public Health, Brian Hale, says the clinic still advertises itself as an abortion provider, and a doctor there still performs the procedure.
