Rudolph Lawyers Challenge Eyewitness

Birmingham, AL – Defense lawyers for Eric Robert Rudolph are challenging a man who says he saw Rudolph near the scene of the 1998 abortion clinic bombing in Birmingham. Rudolph's lawyers are trying to use City University of New York psychology professor Steven Penrod to challenge the testimony. Penrod has testified in other cases about the difficulty witnesses have in accurately identifying people not of their own race. The eyewitness is black -- Rudolph is white. Prosecutors say such testimony would be unscientific and also say such evidence has been barred in other courts.
