 A judge says he will decide by the end of the week if former Governor Don Siegelman should be released from prison while appealing his 2006 bribery conviction.    U.S. District Court Judge Clay Land held a hearing Monday in Montgomery. Siegelman was transported to the hearing from a federal prison in Louisiana.    Land said he has to decide the likelihood of Siegelman winning before the 11th U.S. Circuit Court of Appeals next month. A federal judge has scheduled a hearing for former Gov. Don Siegelman's latest request to get out of prison.

Defense lawyers are asking the judge to free Siegelman while he appeals his 2006 bribery conviction. Lawyers say the release is merited since his appeal has gone on much longer than anticipated. The hearing is scheduled for Dec. 15.

U.S. District Judge Clay D. Land of Georgia issued the order Monday. Land also approved of Siegelman attending the hearing. An appellate judge gave Land the case after Alabama judges recused themselves.

Former Alabama Gov. Don Siegelman will remain in prison while he appeals his conviction.

The 11th U.S. Circuit Court of Appeals in Atlanta said the former governor must remain incarcerated while judges consider his request for a new trial. Al.com reports the hearing was scheduled to start in July. It's now expected to happen early next year.

Siegelman's attorneys said the prosecution was marred by judicial mistakes and politics.

A federal appeals court has delayed Gov. Don Siegelman's case again.

In April, the 11th U.S. Circuit Court Appeals tentatively scheduled Siegelman's case for the week of July 28. Then the court moved it to the week of Oct. 13, and now records show it has been tentatively reset for the week of Dec. 8.

A federal jury in 2006 convicted Siegelman and former HealthSouth CEO Richard Scrushy on bribery and other charges. Prosecutors said Scrushy bribed Siegelman for a spot on a state regulatory board with donations to Siegelman's 1999 lottery campaign.

Former Gov. Don Siegelman is asking a federal appeals court to grant him a new trial on his 2006 bribery conviction.

Siegelman's attorneys filed papers with the 11th U.S. Circuit Court of Appeals arguing that the case was tainted by the U.S. attorney in Montgomery having ties to Republican politics. They also argued that the trial judge erred in sentencing the former Democratic governor.

Former HealthSouth CEO Richard Scrushy, who was convicted with Siegelman, raised the U.S. attorney argument in his appeal, and it was rejected by the 11th Circuit last month.

The 11th U.S. Circuit Court of Appeals let stand Scrushy's 2006 conviction for arranging $500,000 in donations to former Gov. Don Siegelman's lottery campaign in return for Siegelman appointing him to a state hospital regulatory board. Scrushy argued that he should get a new trial because of judicial and juror bias, but the Atlanta-based appeals court ruled against him 3-0 Monday.

A three-judge panel of the 11th U.S. Circuit Court of Appeals will hear arguments as former Health South CEO Richard Scrushy appeals a lower court decision denying his request for a new trial of his 2006 conviction in a government corruption case.

Former Alabama Gov Don Siegelman was also found guilty in that case and is serving a sentence in a federal prison in Louisiana. Scrushy is out of prison and living in Houston after having completed his sentence.

Former Alabama Gov. Don Siegelman heads back to federal court in Montgomery today for a new sentencing hearing for his conviction on bribery and other charges.

A judge will decide Siegelman's new sentence and could order the 66-year-old former governor to immediately return to federal prison after more than four years of freedom.
