Birmingham, AL – Defense attorneys say they will not use an insanity plea to fight the death penalty if Eric Rudolph is convicted for bombing a Birmingham abortion clinic. Lawyers Monday were asking a federal court for more time to reveal their potential expert witnesses to prosecutors when they made the statements. The attorneys did not say how they would fight a death sentence if jurors do convict their client. Jury selection is set to begin in late March in the federal death penalty trial for the 1998 bombing. The explosion killed a Birmingham police officer. Rudolph is also acccused of fatal bombings in Atlanta in 1996 and 1997.
