Judge in Bombing Trial Will Hold Another Hearing

By Alabama Public Radio

Birmingham, AL – A judge will hold a hearing to determine whether prosecutors can show jurors a model of the bomb that exploded outside a Birmingham abortion clinic in 1998. Eric Robert Rudolph is charged with that blast, which killed a police officer and severely injured a clinic nurse. U-S- District Judge Lynwood Smith has set a hearing for March 28th in Huntsville. Rudolph's defense has asked the judge to bar prosecutors from using the model, which was made by a government expert. The defense also is challenging the forensic work involved in examining the bomb fragments, and the judge has agreed to also hear testimony on that issue.
